Emotional Distress

A 17 year old is walking home from church with his father when a drunk driver runs him over.  The 17 year old is killed instantly, the father is untouched.  Should the father be able to recover for his "emotional distress" even though he wasn't physically injured?   The insurance company said that its policy only provided coverage for "bodily injuries" so they weren't going to pay anything.

 A lawsuit was filed against the insurance company.  The trial court found in favor of the father.  The insurance company appealed it to the Superior Court.  The Superior Court found in favor of the father.  The insurance company appealed it to the Supreme Court.  The Supreme Court has not yet made a decision... stay tuned.
